  • The post also implicated President William Ruto, leading to legal action, with the case being prosecuted by the ODPP in Milimani Law Courts.

Activist David Morara, also known as Morara Kebaso SNR, has been formally charged with cyber harassment under the Computer Misuse and Cybercrimes Act No. 5 of 2018.

The charge sheet, issued on October 1, 2024, accuses the activist of publishing false and defamatory content targeting Uasin Gishu businessman David Langat.

The post also implicated President William Ruto, suggesting that Ruto was involved in acquiring Langat’s properties at a lower price, allegedly using his influence to devalue them.

The charge sheet quotes the post, which stated: “William Ruto approached DL Langat and told him he desperately needs more money for campaigns. DL Langat used his properties as security and took big loans to help his friend. Right now DL Langat is being auctioned by banks and the person who is buying the properties is William Ruto.”

It further accused Ruto of leveraging his power to undervalue Langat’s properties.

Authorities deemed this content false, malicious, and damaging to the reputation of David Langat, leading the businessman to file a complaint with the police.

The statement was seen as harmful to both Langat’s business and personal image, prompting legal action.

The case is supported by key witnesses, including CPL Edwin Metto, a digital forensics expert from the Communications Authority of Kenya (CAK), and C.I. Nickson Kinyua.

The prosecution is being handled by the Office of the Director of Public Prosecutions (ODPP), with proceedings set to take place at the Milimani Law Courts.
