Instead, the DPP recommended that DJ Joe Mfalme and the five co-accused be utilized as state witnesses in the investigation into Kelian’s murder.
However, the DPP directed that Mfalme’s friend and MC, Allan Ochieng, also known as Hype Ballo, should be prosecuted for the murder.

In a letter dated April 5, 2024, the DPP advised that the second respondent to the seven individuals be enlisted as witnesses in the case.
Consequently, DJ Joe Mfalme, Eric Kariuki Gathua, Simon Wambugu Wanjiru, Khadija Abdi Wako, Sammy Cheruyot Rotich, and Agnes Kerubo Mogoi have been designated as state witnesses.
