Despite pleading not guilty, he was granted a cash bail of Ksh.1 million.
The prosecution alleges that Ogenga misused his office by conferring a benefit of Ksh.4,800,654 to Xponics Limited.

This benefit supposedly occurred through authorizing payments to the company for a tender involving the supply, delivery, installation, training, servicing, maintenance, and repair of sewing and training machines.
As part of the bail conditions, the court instructed Ogenga not to interfere with the witnesses involved in the case and to deposit his traveling documents with the court.
Former NITA Boss Paul Kipsang Kosgei was also charged alongside Ogenga but did not enter a plea. The court ordered Kosgei to appear in court on Wednesday for plea-taking.
